Evict Now, Appeal Later
Archive of Truth in Exile: In Denmark’s housing system, the eviction moves immediately while the appeal limps behind it... Series 4, Episode 16
A system shows its true nature not when it is tested, but when it is trusted.
Episode 16 is what happens when trust meets a system designed to protect itself.
The Architecture of Injustice
The first structure is to confuse, create uncertainty, and exhaust the intended person: the targeted person.
The second is to disregard his rights to a translator.
The third is not to give him a chance to explain himself well.
The fourth... and this should have been the first, is not to seek ways to provide him with a defence advocate when the advocate he appointed had reasons that prevented him from attending the eviction meeting.
The fifth... and this is the complete tricky injustice practice in the bailiff’s court, is to put him into two aggressive options: talk with the lawyer of the company to get a chance to move out, or be evicted today and appeal within four weeks.
All these points show that the eviction was predetermined.
What followed in the meeting was not a process of justice, but the performance of one... a theatre play where the ending was already written.
I have never, ever heard of a justice like this, not even in the many underdeveloped or dictatorial lands I lived in for years and fled from.
I felt as if I were living in a land on another planet.
For a moment, I was about to laugh... the same strange laughter I used in the last three years to cure the pain they caused in my heart, but I held myself.
Here is the funny story of justice in the eviction meeting... funny only because the alternative is to cry.
The Theatrical Injustice with Its Coded Paragraph
The official called me in. I entered and found the housing company’s advocate already inside, along with another official. That was how it started.
The official opened the meeting with her introductory speech, mentioning the cause and immediately pointing to the absence of my lawyer. I confirmed it: he had told me he had a court case at the same date and time in another city.
When she mentioned the verdict of the first hearing in the city court, I explained why the verdict was not final and why I had appealed it. I said the verdict was declared without cross examination and relied on a lie of a policeman and this was the injustice I appealed. I pointed to the section of the Rent Act and said it was not justifiable and that its wording itself carried injustice.
The company’s lawyer then spoke about her grounds for eviction, referring them to the unjustifiable verdict, and took her time to explain. I understood some of what she said, but I could not follow many of her points.
From what I did understand, I told them I had nine legal points written as notes in my iPhone. I could not see them clearly because of my vision problem, although I managed to read the first one written in English.
The official, as if she was a hurry to finish this job said she could take the points from the iPhone and type them into her laptop. I handed her the phone. She typed a little. I asked her if she had written all nine points. She said she had taken “what’s necessary,” speaking in Danish.
The company’s lawyer continued speaking for a long time, too fast for me to follow. I asked her to repeat some of what she had said. It was clear that I did not understand much of what they were saying.
Then the official seemed ready to go with the section of the Rent Act, even though it was not justifiable. I asked again whether she had written all my points. She said yes.
When I handed her the iPhone, I also gave her a USB containing documents that support my case:
the background of the housing company’s acts against me since January 2023, including the story of the “Beasts of Darkness” in the apartment above mine,
the story of reporting the housing company to the police on October 2023 and the police chief refusing to open a case first against unknown people occupying an apartment that was not rent and second against the housing company and how the chief of the police ordered me out of the station,
the response from the Police Complaints Authority indicating that I could receive compensation for what happened in that apartment, and...
a message I had sent the company long ago explaining the false accusation that I threatened a policeman with a knife, clarifying what actually happened and that I never raised a knife against anyone.
I also gave her a printed Substack article about the whole story.
After all this, she said: “You have to evict today. You have the right to appeal within two weeks… or you can talk with the landlord to process the eviction.”
Putting me in this position was an intentional deprivation of the right choice and the right justice. I felt the weight of having no lawyer, no translator, and above all the feeling of someone forced to sit in a meeting without any defence against powerful authority. And to me, this is the perfect situation for the Danish justice system to work properly.
So I asked: “What is the purpose of the appeal then, when I am already being evicted? This is injustice.”
She said I could talk with the company’s lawyer to get time to move out. He first said one week, then two. I told them it was impossible to find another apartment in two weeks. They said I could contact the municipality. I told them I had called many times and could not get through their new calling system in which I was stuck with a robot.
The lawyer then said I had four weeks.
When the official came to the decision, I told her she must read the documents on the USB. She said I could send them by email and gave me the address. I told her there was no reason to do that now, as long as you had already made your decision.
Laughing to Survive and Talking to H.C. Andersen
“But he hasn’t got anything on!”
Cycling home on my bike, moving through lines of streets on my way to a small supermarket to buy some juice, I started thinking out loud.
I repeated her words to myself: “You should evict today, and you have two weeks to appeal.”
I laughed.
Is this really happening in a state in Europe… in Scandinavia?
So why should I appeal when the eviction is already done?
Are you serious?
Is this justice at all?
What a shame.
If H.C. Andersen heard this, he would be ashamed in his grave.
Many times I cycled around places I enjoy, despite the pain in my heart… I talk to breath that pain out of my chest.
I rest when I talk that pain out..
I tell myself: I am not the one who should face this in this land.
You have someone like H.C. Andersen living among you, and you don’t even see him.
Can you see this H.C. Andersen and what your city has become?
A brief about H.C. Andersen
Andersen himself was sourced out of Persian and Arab folktales and legendary stories.
So this phrase “But he hasn’t got anything on!” is the one I learned with my generation in elementary school, when we were children, with a picture of a Pharaoh walking naked.
It stayed with me all my life.
And now, in this land, I find myself repeating it again not in a classroom, but in the streets of a city that can no longer see its own nakedness.
A cowboy on a bike
Sometimes I even laugh, when people look at me wearing my cowboy hat with its design in the colors of a tiger’s skin, I say, “Yes, Clint Eastwood on a bike.”
Not on a horse.
Not with a gun.
Just a pen I carried all my life, a cowboy tiger hat, and a city that doesn’t know how to compensate me.
Synopsis
Episode 16 traces the anatomy of a predetermined eviction disguised as a legal meeting. It begins with the systematic stripping of rights: confusion as a tactic, the removal of a translator, the denial of a chance to explain, and the absence of a defence advocate whose non‑attendance the system made no effort to remedy.
These steps reveal a structure designed not to listen, but to exhaust and corner the targeted person.
Inside the meeting room, the performance continues. The company’s lawyer speak rapidly in Danish, ignoring the fact that much of it is incomprehensible to me. My nine legal points are reduced to “what’s necessary,” and the documents I brought (evidence of harassment, police misconduct, and the housing company’s actions) are brushed aside. The verdict is delivered before the documents are even read: evict today, appeal later. A theatre of justice where the ending was written before the curtain rose.
Leaving the building, I cycled through the city, speaking my thoughts aloud to survive the weight in my chest. That pain is intentional. As if saying: this person challenges power and we should break him.
I repeated the absurd line: evict today, appeal within two weeks and laughed, because laughter is the only medicine left. I wondered how such a scene can exist in Europe, in Scandinavia, in a land that claims justice as a virtue.
And then I remembered the line from childhood, learned with a picture of a naked Pharaoh: “But he hasn’t got anything on!” H. C. Andersen’s borrowed truth, sourced from Persian and Arab folktales, returned to me as the only honest description of what I just witnessed.
Cycling through streets I once enjoyed, I spoke to the city:
You have someone like H.C. Andersen living among you, and you don’t even see him. Can you see this H.C. Andersen and what your city has become?
Episode 16 becomes not only a record of injustice, but a mirror held up to a society that has forgotten the moral imagination of its own storyteller.
