A Civil Meeting That Failed Its Own Legal Standards
A civil eviction meeting is governed by clear procedural principles: the right to legal representation, the right to understand the proceedings through translation when needed, the right to present evidence, and the right to equal treatment between the parties.
These are not optional elements.
They are the minimum legal safeguards that ensure a civil process remains lawful. In the eviction meeting examined here, these safeguards were not only absent... they were actively disregarded. The result is a meeting that cannot be considered legally valid under the standards of civil procedure.
The Absence of Legal Representation
The first and most fundamental violation occurred when the meeting proceeded despite the absence of my lawyer. The bailiffs court acknowledged that my lawyer was engaged in another court at the same time, yet it didn’t postpone the meeting or provide alternative legal representation.
In civil proceedings, especially those with significant consequences such as eviction, the right to counsel is a core procedural guarantee. Continuing without ensuring representation is not a minor oversight; it is a breach that undermines the legitimacy of the entire process.
The Lack of Translation and Understanding
A second violation concerns the absence of a translator. Civil procedure requires that all parties understand the content and implications of the meeting. When a participant cannot fully follow the language used, the court must provide translation to ensure comprehension and fairness. And when a person spoke in English, so that was a sign he couldn’t speak or understand the other used language.
In this meeting, no translator was offered, requested, or arranged, despite the complexity of the legal issues and the imbalance created by the housing company’s lawyer. This failure directly affects the ability to respond, defend, and participate meaningfully.
The Denial of Time to Speak
A lawful civil meeting must allow both parties adequate time to present their positions. In this case, I was not given sufficient time to speak or explain my points. The meeting moved forward at a pace that prevented proper articulation of my defence.
Civil procedure is built on the principle of hearing both sides: audi alteram partem. When one side is effectively silenced, the process ceases to be civil and becomes procedurally defective.
The Refusal to Accept Evidence
Another serious violation occurred when the court refused to accept the documents I had prepared on a USB. Evidence is central to any civil dispute.
The refusal to receive, review, or even temporarily hold the documents, combined with the instruction to send them only after the decision had already been made, nullifies the purpose of presenting evidence.
A decision made without considering available evidence is not a legal decision; it is an administrative act disguised as a judicial one.
Unequal Treatment Between the Parties
Civil procedure requires equal treatment of both sides. In this meeting, the housing company was allowed to present its claims without interruption, while my ability to respond was restricted.
Their lawyer was present; mine was not. Their documents were accepted; mine were rejected. Their time was respected; mine was limited. This imbalance is not compatible with the principles of civil justice. Equality before the law is not symbolic... it is procedural.
A Meeting That Cannot Stand as a Legal Act
When a civil eviction meeting is conducted without legal representation, without translation, without the acceptance of evidence, and without equal treatment, it cannot be considered a lawful proceeding.
These are not technicalities. They are the foundation of procedural fairness. A process that ignores these foundations becomes invalid, regardless of the outcome it produces.
The legality of a decision depends on the legality of the process that produced it. Here, the process failed at every essential point.
A Structural Failure, Not a Personal Dispute
Episode 26 is not about personal conflict with a housing company. It is about the structural failure of a civil institution to uphold the minimum standards of legality.
When a Bailiffs Court conducts a meeting that violates the core principles of civil procedure, the issue is not only the decision made... it is the integrity of the system itself.
A civil eviction cannot turn illegal without consequences for the legitimacy of the judicial process.

A civil eviction meeting cannot be considered lawful when its basic procedural guarantees are absent. The legitimacy of any decision depends on the fairness of the process that produced it, and in this case, the process failed at every essential point:
representation was denied,
comprehension was not ensured,
evidence was excluded, and...
equality between the parties was not upheld.
These are not secondary details but core legal requirements that define the boundary between a valid civil procedure and an invalid one.
When a bailiffs court allows an eviction meeting to proceed under such conditions, it is not merely committing administrative errors... it is undermining the legal standards it is obligated to protect.
This episode documents that failure clearly, so that the record reflects not only the outcome of the meeting, but the procedural illegality that shaped it from the start.
